§2 Allgemeine Übersicht der Daten und Verarbeitungsvorgänge
Wir wollen Ihnen die geforderte Übersichtlichkeit gem. Art. 12 DSGVO bieten. Daher folgende Übersicht der Verarbeitungen:

Ausführliche Rechte:
gemäß Art. 15 DSGVO Auskunft über Ihre von uns verarbeiteten personenbezogenen Daten zu verlangen. Insbesondere können Sie Auskunft über die Verarbeitungszwecke, die Kategorie der personenbezogenen Daten, die Kategorien von Empfängern, gegenüber denen Ihre Daten offengelegt wurden oder werden, die geplante Speicherdauer, das Bestehen eines Rechts auf Berichtigung, Löschung, Einschränkung der Verarbeitung oder Widerspruch, das Bestehen eines Beschwerderechts, die Herkunft ihrer Daten, sofern diese nicht bei uns erhoben wurden, sowie über das Bestehen einer automatisierten Entscheidungsfindung einschließlich Profiling und ggf. aussagekräftigen Informationen zu deren Einzelheiten verlangen;
gemäß Art. 16 DSGVO unverzüglich die Berichtigung unrichtiger oder Vervollständigung Ihrer bei uns gespeicherten personenbezogenen Daten zu verlangen;
 
gemäß Art. 17 DSGVO die Löschung Ihrer bei uns gespeicherten personenbezogenen Daten zu verlangen, soweit nicht die Verarbeitung zur Ausübung des Rechts auf freie Meinungsäußerung und Information, zur Erfüllung einer rechtlichen Verpflichtung, aus Gründen des öffentlichen Interesses oder zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen erforderlich ist;
 
gemäß Art. 18 DSGVO die Einschränkung der Verarbeitung Ihrer personenbezogenen Daten zu verlangen, soweit die Richtigkeit der Daten von Ihnen bestritten wird, die Verarbeitung unrechtmäßig ist, Sie aber deren Löschung ablehnen und wir die Daten nicht mehr benötigen, Sie jedoch diese zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen benötigen oder Sie gemäß Art. 21 DSGVO Widerspruch gegen die Verarbeitung eingelegt haben;
 
gemäß Art. 20 DSGVO Ihre personenbezogenen Daten, die Sie uns bereitgestellt haben, in einem strukturierten, gängigen und maschinenlesebaren Format zu erhalten oder die Übermittlung an einen anderen Verantwortlichen zu verlangen;
 
gemäß Art. 7 Abs. 3 DSGVO Ihre einmal erteilte Einwilligung jederzeit gegenüber uns zu widerrufen. Dies hat zur Folge, dass wir die Datenverarbeitung, die auf dieser Einwilligung beruhte, für die Zukunft nicht mehr fortführen dürfen und
 
gemäß Art. 77 DSGVO sich bei einer Aufsichtsbehörde zu beschweren. In der Regel können Sie sich hierfür an die Aufsichtsbehörde Ihres üblichen Aufenthaltsortes oder Arbeitsplatzes oder unseres Kanzleisitzes wenden.
 
Ausnahmen:
Das Recht auf Löschung besteht nicht, soweit die Verarbeitung erforderlich ist
zur Ausübung des Rechts auf freie Meinungsäußerung und Information;
zur Erfüllung einer rechtlichen Verpflichtung, die die Verarbeitung nach dem Recht der Union oder der Mitgliedstaaten, dem der Verantwortliche unterliegt, erfordert, oder zur Wahrnehmung einer Aufgabe, die im öffentlichen Interesse liegt oder in Ausübung öffentlicher Gewalt erfolgt, die dem Verantwortlichen übertragen wurde;
aus Gründen des öffentlichen Interesses im Bereich der öffentlichen Gesundheit gemäß Art. 9 Abs. 2 lit. h und i sowie Art. 9 Abs. 3 DSGVO;
für im öffentlichen Interesse liegende Archivzwecke, wissenschaftliche oder historische Forschungszwecke oder für statistische Zwecke gem. Art. 89 Abs. 1 DSGVO, soweit das unter Abschnitt a) genannte Recht voraussichtlich die Verwirklichung der Ziele dieser Verarbeitung unmöglich macht oder ernsthaft beeinträchtigt, oder
zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen
 
§4 Rechtsgrundlagen allgemein
Bei der Verarbeitung von personenbezogenen Daten, die zur Erfüllung eines Vertrags, dessen Vertragspartei die betroffene Person ist, erforderlich ist, dient Art. 6 Abs. 1 lit. b DSGVO als Rechtsgrundlage. Dies gilt auch für Verarbeitungsvorgänge, die zur Durchführung vorvertraglicher Maßnahmen erforderlich sind.
 
Ist die Verarbeitung zur Wahrung eines berechtigten Interesses unseres Unternehmens oder eines Dritten erforderlich und überwiegen die Interessen, Grundrechte und Grundfreiheiten des Betroffenen das erstgenannte Interesse nicht, so dient Art. 6 Abs. 1 lit. f DSGVO als Rechtsgrundlage für die Verarbeitung.
 
Soweit eine Verarbeitung personenbezogener Daten zur Erfüllung einer rechtlichen Verpflichtung erforderlich ist, der unser Unternehmen unterliegt, dient Art. 6 Abs. 1 lit. c DSGVO als Rechtsgrundlage.
Für den Fall, dass lebenswichtige Interessen der betroffenen Person oder einer anderen natürlichen Person eine Verarbeitung personenbezogener Daten erforderlich machen, dient Art. 6 Abs. 1 lit. d DSGVO als Rechtsgrundlage.
 
Soweit wir für Verarbeitungsvorgänge personenbezogener Daten eine Einwilligung der betroffenen Person einholen, dient Art. 6 Abs. 1 lit. a DSGVO als Rechtsgrundlage.

§5 Bestimmungen für Nutzer der Website
 
Allgemeine Daten bei Aufruf der Seite
Bei der bloß informatorischen Nutzung der Website, also wenn Sie sich nicht registrieren oder uns anderweitig Informationen übermitteln, erheben wir nur die personenbezogenen Daten, die Ihr Browser an unseren Server übermittelt, um Ihnen unsere Website anzuzeigen und die Stabilität und Sicherheit zu gewährleisten. Die Verarbeitung erfolgt auf Grundlage von Art. 6 Abs. 1 lit. f DSGVO (Berechtigtes Interesse).
Logfiles
Die Speicherung in Logfiles erfolgt, um die Funktionsfähigkeit der Website sicherzustellen. Zudem dienen uns die Daten zur Optimierung der Website und zur Sicherstellung der Sicherheit unserer informationstechnischen Systeme. Die Verarbeitung erfolgt auf Grundlage von Art. 6 Abs. 1 lit. f DSGVO (Berechtigtes Interesse).
Die Daten werden gelöscht, sobald sie für die Erreichung des Zweckes ihrer Erhebung nicht mehr erforderlich sind.
Im Falle der Speicherung der Daten in Logfiles ist dies nach spätestens sieben Tagen der Fall. Eine darüber hinausgehende Speicherung ist möglich. In diesem Fall werden die IP-Adressen der Nutzer gelöscht oder verfremdet, sodass eine Zuordnung des aufrufenden Clients nicht mehr möglich ist.

Zusätzlich zu den zuvor genannten Daten können bei Ihrer Nutzung unserer Website Cookies auf Ihrem Rechner gespeichert werden. Bei Cookies handelt es sich um kleine Textdateien, durch die uns bestimmte Informationen zufließen können.

Soweit es nicht anders in dieser Datenschutzerklärung dargelegt ist, erfolgt die Nutzung von Analysewerkzeugen auf der Rechtsgrundlage des berechtigten Interesses gem. Art. 6 Abs. 1 lit. f DSGVO. Dies ist insbesondere der Fall, wenn der Dienst Daten nur pseudonymisiert erhoben werden und der jeweilige Dienst die Daten nicht für eigene Zwecke verwendet. 
Active Campaign
Wir verwenden auf unserer Website ActiveCampaign, ein Dienst für unser E-Mail-Marketing. Dienstanbieter ist das amerikanische Unternehmen ActiveCampaign, 1 N Dearborn St 5th floor, Chicago, IL 60602, USA.
 
Durch Verwendung von Active Campaign können wir unsere Email-Marketing-Aktivitäten organisieren und erkennen, wie erfolgreich diese waren. Die Verwendung erfolgt auf Grundlage von Art. 6 Abs. 1 lit. a DSGVO (Einwilligung). 
 
Es ist dabei möglich, dass Daten in die USA übertragen werden. Bei einer Übermittlung in die USA kann kein ausreichendes Datenschutzniveau garantiert werden. Durch Verwendung von Clickfunnels können wir unseren Vetriebs- und Kundengewinnungsfunnel organisieren und erkennen, wie erfolgreich diese waren. Wir verwenden folgende Dienste und Funktionen von Google: 
Google Analytics
Wir nutzen Google Analytics, um die Nutzung unserer Website analysieren und regelmäßig verbessern zu können. Über die gewonnenen Statistiken können wir unser Angebot verbessern und für Sie als Nutzer interessanter ausgestalten.
Wir verwenden Google Analytics mit der Erweiterung „_anonymizeIp()”. Dadurch werden IP-Adressen gekürzt weiterverarbeitet, ein Personenbezug kann damit ausgeschlossen werden. Soweit den über Sie erhobenen Daten ein Personenbezug zukommt, wird dieser also sofort ausgeschlossen und die personenbezogenen Daten damit umgehend gelöscht.
Diese Website verwendet Google Analytics zudem für eine geräteübergreifende Analyse von Besucherströmen, die über eine User-ID durchgeführt wird. Sie können in Ihrem Kundenkonto unter „Meine Daten“, „persönliche Daten“ die geräteübergreifende Analyse Ihrer Nutzung deaktivieren.
 
 
Google Ads
Wir nutzen das Angebot von Google Ads, um auf externen Websites oder Suchmaschinen auf unsere Website aufmerksam zu machen. 
Im Rahmen dessen verwenden wir die Funktion Remarketing von Google Ads. Mit der Remarketing-Funktion können wir Nutzern unserer Webseite auf anderen Webseiten innerhalb des Google Werbenetzwerks auf deren Interessen basierende Werbeanzeigen präsentieren. Hierfür speichert Google Cookies zur eindeutigen Identifikation eines Webbrowsers auf einem bestimmten Endgerät. Wir verwenden den Google Tag Manager. Dieser Dienst dient der effizienten Verwaltung sogenannter “Tags” (kleine Codeelemente auf der Website). Durch diesen Dienst können wir u. a. andere Google-Dienste leichter verwenden.
Youtube
Wir haben YouTube-Videos in unser Online-Angebot eingebunden, die auf https://www.YouTube.com gespeichert sind und von unserer Website aus direkt abspielbar sind. Diese sind alle im „erweiterten Datenschutz-Modus“ eingebunden, d. h. dass keine Daten über Sie als Nutzer an YouTube übertragen werden, wenn Sie die Videos nicht abspielen. Erst wenn Sie die Videos abspielen, werden Daten übertragen. Auf diese Datenübertragung haben wir keinen Einfluss.
Widerspruchsmöglichkeiten:

Wir setzen den Facebook-Pixel und Custom Audiences der Meta Platforms Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Irland.
 
Durch Verwendung des Facebook-Pixels können wir erkennen, ob eine Facebook-Werbeanzeige erfolgreich war und zu einem Kaufabschluss geführt hat. Weiterhin erhalten wir statistische Daten von Facebook, um die Wirksamkeit unserer Werbeanzeigen zu optimieren. Wir verwenden auf unserer Webseite die Conversion-Tracking-Technologie sowie die Retargeting-Funktion der LinkedIn Corporation. Mithilfe dieser Technologie können Besuchern dieser Webseite personalisierte Werbeanzeigen auf LinkedIn ausgespielt werden. Des Weiteren entsteht die Möglichkeit, anonyme Berichte zur Performance der Werbeanzeigen sowie Informationen zur Webseiteninteraktion zu erstellen. Art. 6 (1) (b) of the GDPR serves as the legal basis for the processing of personal data necessary for the performance of a contract to which the data subject is party. This also applies to processing operations required to carry out pre-contractual measures.

If processing is necessary to safeguard a legitimate interest of our company or a third party and if the interests, fundamental rights and freedoms of the data subject do not outweigh the former interest, Art. 6 para. 1 lit. f GDPR serves as the legal basis for processing.

Insofar as the processing of personal data is required to fulfill a legal obligation to which our company is subject, Art. 6 para. 1 lit. c GDPR as the legal basis.
